A company named HANNFIT Industrial Electronics Pty Ltd operates the website located at hannfit.com.au (the “site”) to provide online access to information about products that available at HANNFIT (the “product”) and to facilitate purchase of Products (the “Service”). These Terms of Use, together with the Conditions of Order, Delivery Information , refund and return policy and Privacy Policy, are referred to as this “Agreement”.  By using HANNFIT website, you agree to each of the following terms and conditions set forth herein (“Terms of Use”). By ordering Products, you agree to the Terms of Use, as well as the Conditions of order , delivery and privacy policy set forth in the site. HANNFIT reserves the right to modify this Agreement at any time without giving you prior notice. Your use of the Site following any such modification constitutes your agreement to follow and be bound by the Agreement as modified. The last date this Agreement was revised is set forth below.

1. Prices

HANNFIT website quotations and offers and related services are only been calculated in Australia AUD The prices throughout this site is excluding GST and any taxes if applicable. At HANNFIT, we make every effort and endeavour to maintain prices on our website. However, factors beyond our control (such as changes in foreign currency exchange rates, transportation and delivery cost changes, changes in base material costs, etc.) may vary costs and we reserve the right to amend prices accordingly.

2. Disclaimer of Warranties.

HANNFIT makes no express, implied warranties or representations with respect to any product, or with respect to the site, the service or the content. HANNFIT expressly disclaims all warranties of any kind, express, implied, statutory or otherwise, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, title and no infringement with regard to the products, the site, the service, and the content. HANNFIT does not warrant what the functions performed by the site or the service will be uninterrupted, timely, secure or error-free, or that defects in the site or the service will be corrected. HANNFIT does not warrant the accuracy or completeness of the content, or that any errors in the content will be corrected. The site, the service and the content are provided on an” As is” and “as available” basis.

At HANNFIT’s visitors IP addresses are periodically reviewed and analysed for the purpose of monitoring, and effectively improving our Web site only, and they will not be shared outside HANNFIT. 3. Stock availability

At HANNFIT we are constantly seeking active in production or obsolete products and sometimes due to the rapid developments within the electronics industry some products on this website may become completely obsolete, discontinued or not available in a wider market during its life. In the event of this happening we apologize for the inconvenience(s) and where possible upon enquiring non-stock products will be quoted or will substitute or suggest a similar product of equal or better quality and functionality.

4. New products

Occasionally, due to reasons beyond our control, new products may be delayed from the time they are posted on the website. We will notify you if the product is not yet available.

5. Limitation of Liability.

In no event shall HANNFIT be liable to the buyer or to any third party for any indirect, incidental, special, consequential, punitive or exemplary damages(including without limitation lost profits, lost savings, or loss of business opportunity)arising out of or relating to (I) Any product or service provide or to be provided by HANNFIT , or the use of inability to use the same; (II) The use of or inability to use the site, the service, or the content, (III) Any transaction conducted through or facilitated by the site; (IV) Any claim attributable to errors, omissions, or other inaccuracies in the site, the service and/or the content; (V) Unauthorized access to or alteration of your transmissions or data, (VI) Statements or conduct of any third party on the site or the service; (VII) Any other matter relating to the products, the site, the service or the content, even if HANNFIT has been advised of the possibility of such damages.

HANNFIT’s sole obligation and liability for product defects shall be, at HANNFIT’s option, to replace defective product or refund to customer the amount paid by customer therefore in no event shall HANNFIT liability exceed the buyer’s purchase price. The foregoing remedy shall be subject to buyer’s written notification of defect and return of the defective product within ten (20) days of purchase. The foregoing remedy does not apply to products that have been subjected to misuse (including without limitation static discharge and damage), neglect, accident or modification, or to products that have been soldered or altered during assembly, or are otherwise not capable of being tested. If you are dissatisfied with the site, the service, the content, or with the terms of use, your sole and exclusive remedy is to discontinue using the site. You acknowledge, by your use of the site, that your use of the site is at your sole risk.

7. Data security

HANNFIT take steps to protect the personal information we hold against loss, unauthorised access, use, modification or disclosure, and against other misuse. When the personal information that we collect is no longer required, we destroy or delete it in a secure manner, in accordance with our documented procedure.

1. Conditions of Order

All orders placed via the Site are subject to the terms of this Agreement, including the Conditions of Order, privacy policy and delivery and refund/return policy information. No change, alteration, deletion or modification of any of this Agreement is permitted without written permission by an authorized HANNFIT representative. Any purported change submitted by a purchaser in any additional documentation is hereby expressly rejected. Orders placed on forms deviating from these terms and conditions may be accepted, but solely on the basis that the terms of this Agreement will prevail.

1. Order Validation and Acceptance.

When you place an order, we may verify your method of payment, shipping address, and others if any, before processing your order. Your placement of an order via the Site is an offer to purchase our Products. HANNFIT may accept your order by processing your payment and shipping the Product, or may, for any reason, decline to accept your order or any part of your order. No order shall be considered to be accepted by HANNFIT until the Product has been shipped. If we decline to accept your order, we will attempt to notify you using the email address or other contact information you have provided with your order.

2. Electronic Communication.

When you place an order via the Site, you are required to provide a valid email address and contact phone number, which we may use to communicate with you regarding the status of your order, advise you regarding shipment of backordered products, quote for out of stock items, and to provide you with any other notices, disclosures or other communications relating to your order. You agree that HANNFIT will not be responsible for any damage you incur, or information you do not receive, as a result of your failure to provide a valid email address and/or phone number.

3. Product Information.

HANNFIT’s website type of products, product description and parameters, the relevant pictures, video and other information are provided by own sources or from internet and relevant suppliers, HANNFIT website do not shoulder the responsibility for the information’s accuracy, integrity, legality or authenticity.

4. Payment.

HANNFIT offers several convenient payment methods as available by Australia Dollar, including Credit-Card Payments and PayPal. 5. International Shipping Charges

Shipping or freight charges, insurance and destination customs duties will be paid by the customer(s). Transportation of goods is committed by international freight forwarding company which is commissioned by the HANNFIT . Customers pay the freight cost to international freight forwarding company through HANNFIT. You understand and agree that in order to facilitate convenient transactions and increase logistics efficiency, HANNFIT, in its own name, entrusts the international freight forwarding company to transport the goods you purchased from HANNFIT’s website. You understand and agree that the related party of HANNFIT or any freight forwarder commissioned by HANNFIT will be able to use your order information during the transportation phase. The freight cost you pay is the full price charged by the international freight forwarding company. HANNFIT only collects the freight cost and settle with the international freight forwarding company. HANNFIT only provides technical and settlement convenience for this purpose, we don’t prepay the freight cost incurred by your order.

HANNFIT quotations are FOB price, we are not responsible for destination countries customs clearance. If customer’s purchased parts were detained or seized by customer’s local customs, HANNFIT can provide some documents for customers, but HANNFIT do not responsible for customs clearance, HANNFIT do not pay customs fee, it’s all customer’s duty to clear the parts from customer’s local customs. HANNFIT will not ship again if parts were detained or seized in customer’s local customs, there no refund of the payment.

6. Freight Damage and Return Policy.

If you receive merchandise that has been damaged in transit, it is important to keep the shipping carton, packing material and parts intact. Please contact HANNFIT customer service immediately to initiate a claim. All returns should be made within twenty days of date of invoice and be accompanied by the original invoice number, certificate of guarantee card if any, part’s picture and a brief explanation or test report of the reason for the return. Returns will not be accepted after twenty days. Returned merchandise must be in original packaging and in resalable condition if necessary. Parts returned due to customer error at time of quote or sale or after included and operated in customer’s circuit or setup will not be accepted.

7. Duties and responsibilities.

HANNFIT is an online trading and service platform and not manufacturer of products, we are just supply the service, help customer to purchase the products which they need and we can only inspect the exterior condition of the goods, but not inner function and functionalities. Returns within twenty days will be accepted, however, customers have no rights to prosecute HANNFIT for non-functional goods, also have no right to ask extra compensations. HANNFIT is a service platform, we are not manufacturers, as such HANNFIT reserve the right of final explanations.
